1. Introduction

These Terms of Use ("Terms") govern your use of the GotYourSix Community Fitness website (gy6cf.co.za), our fitness facility, and related services ("Services"). By accessing our website or using our Services, you agree to be bound by these Terms.

GotYourSix Community Fitness (Pty) Ltd, trading as GY6CF ("we", "us", or "our"), is located at Shop 4, Waterglen Shopping Centre, 402 Mendelssohn St, Waterkloof Glen, Pretoria, 0042.

2. Membership

2.1 Eligibility

Membership is available to individuals aged 18 years and older. Persons under 18 may participate in our programs with written consent from a parent or legal guardian, who must sign the membership agreement on their behalf.

2.2 Membership Agreement

By signing up as a member, you enter into a membership agreement with GY6CF. Membership terms, fees, and conditions are outlined in the membership agreement provided at sign-up. Memberships are managed through the Octiv Fitness platform.

2.3 Fees and Payment

• Membership fees are payable monthly in advance by debit order or as otherwise agreed
• Fees are subject to change with 30 days' written notice
• Failed payments may result in suspension of access until the account is brought up to date
• No refunds will be provided for unused portions of membership fees unless required by law

2.4 Cancellation

Membership cancellations must be submitted in writing (email to info@gy6cf.co.za) and are subject to the notice period specified in your membership agreement. Cancellation during a contract period may be subject to an early termination fee as outlined in your agreement.

3. Facility Rules and Conduct

By using our facility, you agree to:

• Follow all instructions given by GY6CF coaches and staff
• Use equipment safely and for its intended purpose
• Return equipment to its designated area after use
• Maintain appropriate hygiene and wear suitable athletic attire
• Treat all members, coaches, and staff with respect
• Not attend classes or training sessions while under the influence of alcohol or drugs
• Report any injuries, equipment faults, or safety concerns to staff immediately

GY6CF reserves the right to suspend or terminate membership for breach of these rules or any conduct that threatens the safety or enjoyment of other members.

4. Health and Safety

4.1 Medical Disclaimer

You acknowledge that physical exercise involves inherent risks of injury. By participating in our programs, you confirm that:

• You are in good health and physically capable of participating in fitness activities, or have obtained medical clearance to do so
• You have disclosed any medical conditions, injuries, or limitations that may affect your ability to exercise safely
• You will immediately inform your coach of any pain, discomfort, or injury during training

4.2 Assumption of Risk

You voluntarily assume all risks associated with your participation in GY6CF programs and use of our facilities. GY6CF, its owners, coaches, and staff shall not be liable for any injury, loss, or damage arising from your participation, except where caused by our gross negligence.

4.3 Indemnity

You agree to indemnify and hold harmless GY6CF, its owners, directors, employees, coaches, and agents from any claims, losses, or damages arising out of your use of our facilities or participation in our programs.

5. Intellectual Property

All content on the GY6CF website, including text, images, logos, graphics, and design, is the property of GotYourSix Community Fitness and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written consent.

6. Website Use

• You agree to use our website for lawful purposes only
• You must not attempt to gain unauthorised access to our website, servers, or systems
• We reserve the right to modify, suspend, or discontinue any aspect of the website at any time without notice
• Our website may contain links to third-party websites. We are not responsible for the content or practices of those websites

7. Class Bookings

• Classes must be booked in advance through the Octiv Fitness app or platform
• Cancellations should be made at least 2 hours before the scheduled class to avoid a no-show penalty
• GY6CF reserves the right to cancel or reschedule classes and will make reasonable efforts to notify members in advance
• Class sizes may be limited for safety and quality reasons

8. Personal Belongings

GY6CF is not responsible for any loss, theft, or damage to personal belongings brought to the facility. Members are advised not to leave valuables unattended.

9. Photography and Media

GY6CF may take photographs or videos during classes and events for marketing and social media purposes. By attending our facility, you consent to the use of your image unless you notify us in writing that you do not wish to be photographed or filmed.

10. Limitation of Liability

To the maximum extent permitted by law, GY6CF's total liability for any claim arising from your use of our Services shall not exceed the total membership fees paid by you in the 3 months preceding the claim. GY6CF shall not be liable for any indirect, incidental, special, or consequential damages.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of the Republic of South Africa.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
